This TERMS AND CONDITIONS AGREEMENT
sets forth the agreement between True Courage Press and each affiliate
marketer.
Please read this agreement carefully
before joining the True Courage Press Affiliate Program. By joining
the True Courage Press Affiliate Program, you signify your assent to
this Terms of Use agreement. If you do not agree to the terms and
conditions contained in this Terms of Use agreement, please do not
join the True Courage Press Affiliate program.
By joining the True Courage Press
Affiliate Program and promoting our products you are agreeing to abide
by following terms & conditions (rules) set forth
below:
Use Of Downloadable
Software
True Courage Press does not
permit the promotion of our products within downloadable software.
This includes, but is not limited to Browser Help Operators (BHO's),
Search Bar Tools, Shopping Enhancers, Top Moxies, etc... Any affiliate
that is discovered to be promoting our products in any such type of
software will have all sales reversed and their account
terminated.
Trademarks and
Copyright
All Web site design, text, graphics, sound,
software and other content, and the selection and arrangement thereof,
are the property of True Courage Press or its licensors, and are
protected by
United
States
and international copyright
law. All rights to such materials are reserved to their respective
copyright owners. Permission is granted to electronically copy and to
print in hard copy portions of this Web site for the sole purpose of
promoting the True Courage Press Affiliate Program or using this Web
site as a shopping vehicle. Any other use of materials on this site,
including without limitation reproduction for purposes other than
noted above, modification, distribution, replication, commercial or
other exploitation, or creation of derivative works, without the prior
written permission of True Courage Press, is strictly
prohibited.
Promoting the True Courage
Press/LoveDiet.com Brand Name
In order to maintain our
integrity and recognizable brand name in the marketplace, our
affiliates agree not to engage in any fraudulent or misleading
activities, including but not limited to:

Misleading claims or
statements.
·
Operate or utilize a Web site or
email link to Web sites that contain or promote any of these types of
content: libellous, defamatory, obscene, abusive, violent, bigoted,
hate-oriented, illegal, cracking, hacking or warez, or that offer any
illegal good or service, or link to a Website(s) that do so
and/or
·
Engage in spamming, indiscriminate
advertising or unsolicited commercial email; and
·
Engage in cybersquatting or
typosquatting.
Affiliates are not employees or agents
of True Courage Press, its employees or associated persons.We reserve
the right to terminate the affiliate relationship with you for
violation of any of the above mentioned items at any time within our
sole discretion with or without notice.
Payment of Commission
True Courage Press
will pay all of our affiliates within 45 days of the end of each month in which the affiliate’s unpaid
balance is $25 or more.
All
commissions will be paid in
United States
currency. True Courage Press
reserves the right to withhold any commissions which it believes to be
the result of fraudulent or misleading activity such as those being
earned or obtained through the use of spyware, BHOs or any other
commission altering software program.
If True Courage
Press believes, in its sole discretion, that an affiliate is involved in
fraudulent, harmful or misleading activity, than it may suspend payments until
said affiliate activity is proven to be legitimate and ethical.
True Courage Press
will not make any payments to affiliates for prior orders that renewed after a
cancellation or return, or links that did not work properly, that were
improperly entered, that were forgotten to be entered or that were blocked.
Changes
to the Affiliate Program
The Affiliate
Program may end, or any of its terms may change, at any time by an email
message sent to existing affiliates at their respective email address on file
with True Courage Press. Such email messages shall be presumed to have been
constructively received within 12 hours of their transmission. Payments owing
to affiliates under prior terms will be paid according to said prior terms.
True Courage Press reserves the right to remove any party from its Affiliate
Program at any time in its sole discretion.
Applicable
Law; Jurisdiction
This agreement shall be governed
by and construed in accordance with the laws of New Jersey without
regard to choice of law rules. Each user agrees to submit to personal
jurisdiction in
New Jersey and
further agrees that any cause of action arising from or relating to
the use of this site or this agreement shall be brought exclusively in
a court in
New
Jersey
.
